ADA A Litigation
Americans with Disabilities Act Discrimination
The Americans with Disabilities Act (ADA) prohibits discrimination on the basis of disability in businesses that are open to the public; including facilities that offer food, lodging, healthcare, rental services, recreation and/or professional services. Even the landlord of the property where the business is located is responsible for ADA compliance.
ADA Private Enforcement
The size and age of the business does not matter. All businesses and property owners are required to be in full compliance with the Americans with Disabilities Act. Examples include larger bathroom stalls, sinks, grab bars, level entrance ways, doors and hallways that can accommodate wheelchairs, and easy-to-see fire alarms. Even having clogs isles in stores is a violation of the ADA. Not allowing legimite service animals is another common ADA violation.
